WizDance

Terms — draft outline

What a WizDance agreement will have to settle, and what has not been settled yet.

Draft outline — not in force

This is not a privacy policy or a legal agreement, and nothing on this page is binding on anyone.

It is a working list of the questions WizDance has to answer with a lawyer before the first studio signs up. Because the product handles video of children, publishing confident-sounding policy text before that work is done would be worse than publishing none — somebody might rely on it. Please do not treat anything here as a promise, a permission, or a statement of what we do with your data.

Who it will be between
Undecided — WizDance, the studio, and the individual all have a part.

Topics the finished agreement must cover

Each topic below states what the product actually does today, and then the question that is still open. Nothing here commits anybody to anything.

  1. 1. Who this agreement is actually between

    What the product does today

A studio holds the relationship with its dancers. WizDance holds the software. Nobody has signed anything yet, because no studio has signed up yet.

    Still to be decided

Whether the agreement is between WizDance and the studio, with the studio responsible for its own members, or whether every individual also agrees something directly with us — and which of those a parent is being asked to accept on a child's behalf.

Decided by: Founder, with legal counsel

  2. 2. You join a studio by invitation, and only by invitation

    What the product does today

There is no way to sign yourself up to a studio. Somebody at the studio sends an invite, and that invite fixes which studio you join, what you can do there, and your age group. None of it can be changed after the invite is sent — not by you, not by the person who sent it, and not by us.

    Still to be decided

What a studio is promising when it invites somebody, and what it must tell a parent before inviting a child.

Decided by: Founder, with legal counsel

  3. 3. Who owns a tutorial

    What the product does today

Nothing is settled. Tutorials are stored with the person who made them and the studio they were made for, so that whichever answer is chosen can be applied.

    Still to be decided

Whether a tutorial belongs to the teacher who made it, the studio that paid for the time, or WizDance. This decides what happens to a teacher's work when they leave a studio, whether they can take it with them, and what happens to a studio's lessons if that studio is suspended. Deciding it after teachers have uploaded means renegotiating with people whose work is already in the product.

Decided by: Founder, with legal counsel

  4. 4. Music in a teacher's tutorial

    What the product does today

Nothing. There are no upload terms, no takedown route, and no check on what music a tutorial uses.

    Still to be decided

Who carries the risk when a teacher sets a tutorial to a commercial track — the teacher, the studio, or WizDance. It needs three things, not one: terms that say so at the moment of upload, a working takedown route with somebody responsible for it, and a deliberate decision about whether to detect copyrighted music at all. Not deciding is itself a decision, and the worst one.

Decided by: Founder, with legal counsel

  5. 5. Safeguarding, and how to report a concern

    What the product does today

Every action taken inside a studio is recorded permanently, so that anything reported can be looked into. There is not yet a named person at each studio to report it to.

    Still to be decided

Who the named safeguarding owner is at each studio, what the agreement obliges them to do, how a parent reaches them, and what WizDance does when a report arrives. This is both a term in the studio's contract and a field in the system — one without the other is not a safeguard.

Decided by: Founder, with legal counsel

  6. 6. What WizDance costs, and who pays

    What the product does today

Nothing is charged. There is no payment of any kind in the product.

    Still to be decided

Whether the price is per studio, per active dancer, or per tutorial — which also settles what "active" means, and whether a studio could check a bill against its own records.

    Decided by: Founder

  7. 7. Leaving a studio, or a studio leaving WizDance

    What the product does today

When somebody's place at a studio ends, their access to that studio ends with it, and any invites still outstanding for them stop working. When a studio itself is retired, everybody in it loses access.

    Still to be decided

What a dancer keeps afterwards — their own recordings, and anything they downloaded. What a teacher may take with them. How much notice a studio gets, and what a studio can export before it goes.

    Decided by: Founder

  8. 8. Suspending an account or a studio

    What the product does today

A person's place at a studio can be paused or ended by the studio, and takes effect immediately on every screen.

    Still to be decided

When WizDance itself would suspend a studio or a person, what warning is given, how it is appealed, and what happens to the content and recordings in the meantime.

Decided by: Founder, with legal counsel

  9. 9. What the AI feedback will and will not claim

    What the product does today

Movement feedback is designed to stay silent when it cannot see clearly, rather than guess. That matters most for dancers the model's assumptions do not fit — wheelchair dancers and dancers with limb differences — where a confident wrong correction would be worse than none at all.

    Still to be decided

What WizDance commits to in writing about accessibility. The working assumption is the WCAG 2.2 AA standard unless the founder decides otherwise, and it has not been confirmed.

    Decided by: Founder, to confirm

  10. 10. Changes to this agreement, and which country's law applies

    What the product does today

Nothing. There is no agreement to change yet, and no stated jurisdiction.

    Still to be decided

How people are told when terms change and whether they must agree again; which country's law governs the agreement; and how disputes are handled. WizDance is being built for the United States first, which is a starting point rather than an answer.
